DMCA Policy

Overview
VideoNest respects the intellectual property rights of others and expects users of our platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512, VideoNest will respond promptly to claims of copyright infringement that are reported to our designated copyright agent.
If you believe that content hosted on or distributed through VideoNest infringes your copyright, please follow the process below to submit a takedown notice. Submitting a false or misleading notice may expose you to legal liability under 17 U.S.C. § 512(f).
Submitting a Takedown Notice
To submit a valid DMCA takedown notice, send a written communication to our designated agent (contact details below) that includes all of the required elements listed in the next section.
We recommend sending your notice by email to ensure the fastest response. Upon receipt of a valid notice, we will:
- Remove or disable access to the allegedly infringing content promptly.
- Notify the user who uploaded or distributed the content that it has been removed.
- Provide the user with an opportunity to submit a counter-notification if they believe the removal was in error.
Required Elements of a Takedown Notice
Your written notice must include all of the following to be considered valid under the DMCA:
- A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are covered by a single notice).
- Identification of the specific material you claim is infringing and information reasonably sufficient to allow us to locate it on our platform (e.g., a direct URL or description of the content).
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.
Incomplete notices may be disregarded. We may contact you to request clarification before taking action.
Counter-Notification
If you believe your content was removed as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent. A valid counter-notification must include:
- Your physical or electronic signature.
- Identification of the content that was removed and the location where it appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief the content was removed as a result of a mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or any judicial district in which VideoNest may be found if you are outside the United States), and that you will accept service of process from the person who filed the original takedown notice.
Upon receipt of a valid counter-notification, we will forward it to the original complainant and reinstate the content within 10–14 business days unless the complainant notifies us that they have filed a court action to restrain the alleged infringement.
Repeat Infringer Policy
VideoNest maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We reserve the right to terminate any user's access to the platform at our sole discretion if we determine that the user has repeatedly uploaded or distributed content that infringes third-party copyrights.
